The product arrived damaged, stopped working in days, or is not what was promised. The seller refuses a replacement or refund. This is the classic consumer complaint.
What you can get
Replacement of the product, or a full refund; compensation for loss and harassment; litigation costs.
Steps
- Photograph or video the defect before you use the product further, and keep the original packing.
- Complain to the seller in writing (email or app) and keep the reply or the lack of one.
- Register with the National Consumer Helpline (1915 / consumerhelpline.gov.in) — many sellers settle once the NCH forwards the grievance.
- If it is not resolved, file on e-Jagriti (e-jagriti.gov.in) with the forum picked by what you paid.
- Upload the complaint, affidavit, bill, warranty card, photos/videos of the defect and all correspondence as PDFs.
- The Commission may order a lab test of the goods — in that case the disposal target is 5 months instead of 3.
Documents to prepare
- Bill / invoice and warranty card
- Photos or video of the defect
- Payment proof
- Written complaint to the seller and any reply
- Delivery proof
- Notarised affidavit supporting the complaint
Frequently asked questions
- What if the seller says the warranty does not cover it?
- A warranty cannot override your rights under the Consumer Protection Act, 2019. If the product was defective at delivery or failed unreasonably early, that is a deficiency in service / defective goods regardless of what the warranty card says.
- Can the Commission order a lab test?
- Yes. If the defect needs testing, the Commission sends the goods to a lab. The disposal target then becomes 5 months instead of 3.
